Over the past two decades, the country has undergone a significant transformation, especially after the fall of the Saddam Hussein regime, and has seen a shifting legal landscape aimed at encouraging foreign investment. This article highlights the ongoing trends and developments in Iraq, especially within its legal framework, that are pivotal for business operations and investments.
The Federal Supreme Court: Legal Authority and Challenges
A significant element of Iraq’s evolving legal system is the role played by the Federal Supreme Court. This body has been central to Iraq’s legal and political discourse, ensuring that the government remains compliant with the constitution and determining the legality of policies, laws and actions taken by various authorities.
The Federal Supreme Court is constitutionally tasked with overseeing matters of constitutionality, with its decisions being deemed final and binding across all governmental institutions. Article 94 of the 2005 Iraqi Constitution explicitly outlines this authority, affirming that decisions made by the Federal Supreme Court are not subject to appeal.
