Self-regulatory codes apply to and cover issues of interaction with healthcare professionals, healthcare institutions and patient organisations as part of the promotion of pharmaceutical products. This applies to any activity undertaken, organised or sponsored by a member company that is directed at healthcare professionals to promote the prescription, recommendation, supply, administration or consumption of its pharmaceutical product(s) through all acceptable methods of communications.
Provisions of self-regulatory codes of a particular association are the responsibility of the individual company (please also see 11.4 Relationship Between Regulatory Authorities and Courts concerning legal value). In any case, the companies are obliged to adhere to all appropriate laws and other national regulations. Before placing the promo materials or conducting any other promotional activities or interactions with healthcare professionals in Ukraine, they need to check its compliance to the requirements of the national legislation.
The companies must implement and maintain relevant procedures ensuring complete observance of the provisions of the Code and the current legislation as well as the control and monitoring of all activities and materials related thereto.
